What Is a Rental Application Form?
A rental application is the screening document a prospective tenant completes before a landlord decides whether to offer a lease. It gathers the information any owner needs to evaluate risk — identity, employment and income, current and prior addresses, landlord references, and disclosure of pets, vehicles, and additional occupants — and it authorizes the landlord to verify all of it.
The consent language is the part that carries legal weight. Credit reports, criminal background checks, and eviction history reports are consumer reports under the Fair Credit Reporting Act, and pulling one without written permission and a permissible purpose is a violation. The same statute requires an adverse action notice if the application is denied based on the report, naming the reporting agency and telling the applicant how to dispute what it contains. Fair housing law sits on top of all of it: the criteria used to accept or deny must be applied the same way to every applicant.

The Applicant authorizes the Landlord and any screening company acting on its behalf to obtain consumer reports and investigative consumer reports about the Applicant for the purpose of evaluating this rental application and, if a lease is signed, for account review, renewal, and collection purposes during the tenancy. These reports may include credit history and credit score, rental and eviction history, criminal record history where permitted by law, employment and income verification, and public records. The Applicant understands these are consumer reports under the federal Fair Credit Reporting Act, 15 U.S.C. section 1681 and following, and that this signed authorization is the permissible purpose for obtaining them. If the Landlord takes adverse action based in whole or in part on information in a consumer report — including denial of the application, a requirement of a higher deposit, or a requirement of a co-signer — the Landlord will provide an adverse action notice identifying the consumer reporting agency, stating that the agency did not make the decision and cannot explain it, and informing the Applicant of the right to a free copy of the report within 60 days and the right to dispute its accuracy. The Landlord evaluates every application using the same written criteria, which are available on request and include: verifiable gross monthly income of at least [INCOME MULTIPLE, e.g., 3] times the monthly rent, a minimum credit score of [MINIMUM CREDIT SCORE] or an acceptable equivalent, no unpaid judgment or balance owed to a prior landlord, positive references from the [REFERENCE PERIOD, e.g., past two years] of rental history, and consideration of criminal history only as permitted by applicable law and only through an individualized assessment of the nature, seriousness, and recency of the conduct. 10. 10. Applicant Certification
The Applicant certifies that every statement in this application is true, complete, and accurate, and understands that a false or incomplete statement is grounds for rejecting the application or, if discovered later, for terminating any lease that results from it. The Applicant understands that this application is not a lease, that no tenancy is created unless and until a written lease is signed by both parties and any required deposit is paid, and that the Landlord may continue to accept and consider other applications until that happens. Landlords should keep the authorization separate and clearly worded rather than burying it in fine print, and should note what it covers — including whether it extends to account review during the tenancy. Applicants should read the scope and the validity period, since an open-ended authorization can be reused for later pulls. Pulling a report without this consent is an FCRA violation with statutory damages attached.
Adverse Action Notice
Commits the landlord to telling the applicant when a denial or a higher deposit is based on a consumer report.
This is a legal requirement, not a courtesy, and it applies to a single-unit owner as much as to a management company. The notice must identify the reporting agency, state that the agency did not make the decision, and explain the right to a free copy and to dispute errors. Applicants who are denied should always request the report, since screening errors and mismatched records are common.
Application Fee and Refund
Discloses the fee, what it covers, and whether any unused portion is returned.
Several states cap the fee at the actual cost of screening, require an itemized receipt, or prohibit collecting a fee when the unit is already rented. Applicants should confirm the fee is per adult and ask whether a recent reusable screening report is accepted, which some states require. Landlords should not treat the fee as a holding deposit — those are different things with different refund rules.
Written Screening Criteria
Publishes the income, credit, and history standards that will be applied to every applicant.
Consistency is the defense against a fair housing complaint. Landlords should write the criteria down, apply them in the same order to every applicant, and document the reason for each decision. Applicants should ask for the criteria before paying a fee — if the income multiple or credit floor is out of reach, there is no reason to pay for a screening that cannot succeed.
Income and Source of Income Disclosure
Collects verifiable income while treating assistance, subsidy, and support payments as voluntary disclosures.
A growing number of states and cities make source of income a protected class, which means refusing a housing voucher is unlawful there. Landlords should count all lawful income toward the qualification multiple rather than only wages. Applicants should provide documentation for every income stream they want considered, because unverified income is usually treated as zero.
Criminal History Consideration
Limits how criminal record information is used and requires an individualized assessment.
Blanket bans on anyone with a record can produce a disparate impact and have been challenged under fair housing law, and several jurisdictions now have fair chance housing ordinances restricting when the question can even be asked. Landlords should look at the nature, seriousness, and recency of the conduct and give the applicant a chance to explain. Applicants should know when local law prohibits the inquiry entirely.
Certification and No Tenancy Created
Confirms the information is accurate and that submitting an application does not create a lease.
Applicants should be accurate about prior evictions and reasons for leaving, since a discrepancy against the screening report is treated as a false statement and is a common ground for later termination. Applicants should also note that approval usually comes with a short deadline to sign and pay — often forty-eight hours — after which the unit can go to someone else.
